Cafe Q - Sacramento

Members can upload photos to Cafe Q, link to photos on another site such as Flickr, PhotoBucket or MySpace, and create separate albums for different classes of photos. They can also allow their photos to be seen by everyone, just their friends or just themselves. Photos can also be embedded in Blogs and on Forum postings.

Privacy settings: You may designate your photos to be viewable by everyone, just your friends or just yourself. Just click on the photo and, in the right column, check one of the privacy settings.

Photo Content: You may post and make visible to everyone, without permission,  any photo of yourself or photos you have taken of crowd scenes or landscapes or other objects  provided that they do not contain sexually explicit content or invade a person's privacy. A photo may invade a person's privacy, even if in a public place,  if the individual did not reasonably expect the photo to be taken or if the photo shows the person in an embarrassing situation. For instance, a fat man walking down the street with a large dresser mirror whose pants suddenly fall to his knees. You should not post closeups of persons in public places without their permission.

Exception for implicit permission:  A person has given their implicit permission if they appear in a public setting under circumstances that clearly show they did not reasonably expect any privacy.  For instance, talking to a public gathering, marching in a parade, staffing a booth at a farmer's market or Pride festival, etc.

Identifying persons by name: Generally, one should not state the name of a person in a photo unless it is apparent that the person would approve.  For instance, it is not a good idea to post a photo of a primarily gay crowd scene and than identify persons in the crowd by name. This allows persons searching the web to easily discover the picture of the person and their association with a gay event. Many persons attending gay events do not care to be identified in a manner that their association with the event can be easily discovered by employers, family members, etc. It is perfectly OK to identify by name persons who speak or perform at the event

Copyrighted or Licensed Photos: You may not post any photo to Cafe Q, public or private, that violate any copyright or licensing law. When permissi0on is required and granted, it must be clearly stated in the caption to the photo.
