At the bottom right corner of this page (in the red footer) are links to Ning's Privacy and Terms of Use policies. You should read these policies before registering. During registration you will be asked to check a box stating that you have read and understand them in addition to the Waiver of Rights and Code of Conduct stated below.
General Waiver: As a condition for becoming a member of Cafe Q, you agree to waive all causes of action against Cafe Q for defamation and invasion of privacy arising out of any positing on Cafe Q by any other member. This means you may be able to sue the individual who posts the content but you cannot sue Cafe Q. You also agree to waive all causes of action against Cafe Q for any injury you suffer as a result of persons distributing content you post on Cafe Q. This means that if you post personal information on Cafe Q and someone later publishes or distributes that information to others, you may not sue Cafe Q for damages. This includes not only personal information but also copyrighted works that you post on Cafe Q. You may, of course, inform Cafe Q of the acts you believe are damaging to you and, if Cafe Q finds the acts in violation of Cafe Q's Code of Conduct, it shall take appropriate action.
Code of Conduct:
A member of Cafe Q may be banned from the site for violation of any of the following rules of conduct. By banned we mean that all content that person has posted shall be removed, the person's membership shall be canceled and the person may not be allowed to join Cafe Q again.
No member shall:
--Post any language or image that demeans or humiliates any member.
--Post any language or image that invades another's privacy or defames the person.
--Post another member's true name, email address, phone number or other personal information without that person'sexplicit consent.
--Bother or harass any other member after that person has requested that he refrain from such conduct.
--Post any nude photo of him/herself or any other person.
--Post any sexually explicit writings. Sexually explicit writings are those that:
--describe sexual conduct or acts in graphic or vulgar terms, or
--describe sexual conduct in a manner intended to arouse another
--Post any sexually explicit artistic images. Sexually explicit images are those that:
--depict the male nude in an aroused state and in a vulgar manner
--depict sexual acts in a vulgar manner.
By "vulgar" we mean without artistic merit. In judging whether a particular depiction violates this rule, we consider the person's formal art or literary education, their recognition in the art or literary world (prizes, exhibits, etc.), their intentions or purpose in posting the work and the general context for the posting.
Images or writings that are alleged to be posted solely for scientific or medical purposes are judged on the basis of the credentials of the person making the post, the material itself and the context in which the post is made. Cafe Q retains all rights to remove without notice all content it deems inappropriate .
Cafe Q does not censor materials posted in areas of the site that a member has designated as visible only to him/herself or friends unless such materials appear to be in violation of law. (e.g. depictions of minors, etc.)
--Post any commercial content or advertisement, especially for the purpose of profit or to promote a particular product for valuable consideration. This does not exclude posting a recommendation for a particular product in an appropriate forum. (For instance recommending a particular camera in a photography forum provided that the person making the recommendation does not stand to gain any valuable consideration for doing so.)
--Members who own businesses should be especially careful that they do not post ads for their business on the events calendar under the guise of being an event. A special offer or sale is not an event. This does not exclude businesses posting ads for free events such as author book signings, artist receptions, open mike, poetry readings, exhibits, etc. If you have a question as to whether a particular activity is eligible for posting, contact us first.
